PLEASE READ THESE TERMS CAREFULLY. By subscribing to The Brotherhood Box or using our services, you agree to be bound by these Terms of Service. If you do not agree, please do not subscribe or use our services.
1. GENERAL INFORMATION
These Terms of Service ("Terms") govern your subscription to and use of The Brotherhood Box services, operated by Kalos Health LLC ("we," "us," or "our"), located in Los Angeles, California.
The Brotherhood Box provides subscription services consisting of quarterly curated wellness product boxes and/or monthly peer coaching services designed to support men's personal development and well-being.
2. ELIGIBILITY
You must be at least 18 years of age to subscribe to The Brotherhood Box services. By subscribing, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. SUBSCRIPTION PLANS AND PRICING
Available Plans
We offer the following subscription plans:
- The Brotherhood Box: $88 per quarter Includes: Quarterly curated product box (shipped once per quarter), community access, and monthly group calls. Billing: Charged every 3 months (quarterly).
- Coaching Only: $100 per month. Includes: 40 minutes of monthly 1:1 peer coaching (which may be split into two 20-minute sessions), unlimited group coaching sessions based on availability, and community access. Billing: Charged monthly. Note: This plan does NOT include physical product boxes.
- Box + Coaching: $350 per quarter. Includes: Everything from both plans above - quarterly curated product box, 40 minutes of monthly 1:1 peer coaching (which may be split into two 20-minute sessions), unlimited group coaching sessions based on availability, monthly group calls, and community access. Billing: Charged every 3 months (quarterly).
Pricing and Payment
All prices are in U.S. Dollars (USD). Payment is processed through Shopify Payments according to your subscription plan's billing frequency:
- Box subscribers and Box + Coaching subscribers: Billed quarterly (every 3 months).
- Coaching Only subscribers: Billed monthly.
By subscribing, you authorize us to charge your designated payment method on a recurring basis according to your plan's billing cycle until you cancel your subscription.
Price Changes
We reserve the right to change our subscription prices at any time. Any price changes will be communicated to you at least 30 days in advance and will take effect at your next billing cycle. Your continued use of the service after a price change constitutes acceptance of the new price.
4. BILLING AND RENEWAL
Automatic Renewal
Your subscription will automatically renew according to your plan's billing cycle unless you cancel prior to your renewal date:
- The Brotherhood Box: Renews quarterly (every 3 months).
- Coaching Only: Renews monthly.
- Box + Coaching: Renews quarterly (every 3 months).
You will be charged the subscription fee automatically at each renewal.
Payment Method
You must provide a valid payment method to subscribe to our services. You agree to maintain current, complete, and accurate payment information. If your payment method fails or your account is past due, we reserve the right to suspend or terminate your subscription.
Failed Payments
If we are unable to process your payment, we will attempt to contact you and may retry the charge. If payment cannot be collected within a reasonable timeframe, your subscription may be suspended or cancelled.
5. PEER COACHING SERVICES (For Coaching Only and Box + Coaching Subscribers)
IMPORTANT: Nature of Coaching
The coaching services provided as part of The Brotherhood Box are peer coaching services only. Our coaches are not licensed mental health professionals, therapists, counselors, or medical providers. The coaching provided focuses on:
- Personal goal setting and accountability.
- Habit formation and lifestyle strategies.
- General wellness and personal development support.
- Peer support and shared experiences.
Peer coaching is NOT a substitute for professional mental health treatment, medical advice, diagnosis, or therapy. If you are experiencing mental health concerns, suicidal thoughts, or medical issues, please contact a licensed mental health professional, your physician, or emergency services immediately.
Coaching Session Details
For subscribers to the "Coaching Only" or "Box + Coaching" plans:
- You receive 40 minutes of 1:1 peer coaching per month.
- This time may be used as one 40-minute session OR split into two 20-minute sessions.
- You have access to unlimited group coaching sessions based on availability and scheduling.
- Coaching sessions are conducted via video call.
- Sessions are not recorded.
Scheduling and Booking
After subscribing to a coaching plan:
- You will receive a personalized scheduling link within 24 hours.
- You are responsible for booking your sessions through the provided scheduling system.
- Multiple time slots will be available for your convenience.
- Group session schedules will be posted in advance in the community platform.
Cancellation and No-Show Policy
Cancellations by You:
Timely Cancellation: You may cancel or reschedule a 1:1 session with at least 24 hours' notice without penalty
Late Cancellation: If you cancel with less than 24 hours' notice, this is considered a "late cancellation." You may reschedule the session, but you are allowed only ONE late cancellation per month. Additional late cancellations will result in forfeiture of 20 minutes of your monthly coaching time
No-Show: If you do not attend a scheduled session without cancelling, you will forfeit 20 minutes of your monthly coaching allocation
Group Sessions: If you book a group session and do not attend, the coach reserves the right to restrict your future group session access at their discretion
Cancellations by Coach:
If a coach needs to cancel your session, we will work with you to reschedule at a time that is convenient for you, and you will not lose any of your allocated coaching time.
Unused Coaching Time
Coaching minutes do not roll over from month to month. If you do not use your allocated coaching time in a given month, those minutes are forfeited. You will still be charged your subscription fee (monthly for Coaching Only, quarterly for Box + Coaching) regardless of whether you utilize your coaching sessions.
Confidentiality and Privacy
While we respect your privacy during coaching sessions:
- Coaching sessions are conducted via a platform.
- We maintain general records of session attendance and scheduling.
- Coaches may take notes for continuity of care, but these are kept confidential.
- We will not share information from your coaching sessions without your consent, except as required by law or in cases where we believe there is imminent risk of harm to you or others.
Limitations and Disclaimers
By participating in coaching services, you acknowledge and agree that:
- Results from coaching vary and are not guaranteed.
- You are responsible for implementing any strategies or insights gained from coaching.
- Coaches provide guidance based on their personal experiences and training, not professional medical or therapeutic expertise.
- You should consult with appropriate licensed professionals for medical, legal, financial, or clinical mental health advice.
6. PRODUCT INFORMATION AND DISCLAIMERS
Product Contents
Subscribers to "The Brotherhood Box" or "Box + Coaching" plans receive a quarterly curated product box containing wellness products that may include but are not limited to:
- Wellness supplements
- Grooming and self-care products
- Lifestyle and wellness accessories
Note: "Coaching Only" subscribers do NOT receive physical product boxes.
Product contents are curated by us and may vary from quarter to quarter. We do not guarantee specific products or brands in any given box.
IMPORTANT - Allergies and Sensitivities
Our boxes may contain products with common allergens or ingredients that may cause sensitivities, including but not limited to:
- Nuts and nut-derived ingredients.
- Soy, dairy, or gluten.
- Fragrances and essential oils.
- Supplements with various herbs and compounds.
If you have known allergies or sensitivities, it is your responsibility to:
- Review product ingredients before use.
- Consult with your healthcare provider if you have concerns.
- Discontinue use if you experience any adverse reactions.
We are not responsible for allergic reactions or adverse effects resulting from use of products in our boxes.
Supplement and Health Product Disclaimer
Supplements and wellness products included in our boxes are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration (FDA). Always consult with your healthcare provider before starting any new supplement regimen.
Product Safety
All products are intended for external use or as directed on product packaging. Follow all manufacturer instructions and warnings. Keep products out of reach of children.
7. COMMUNITY ACCESS AND CONDUCT
Community Guidelines
As a subscriber, you may have access to community features including online forums, group calls, and member interactions. By participating, you agree to:
- Treat all members and coaches with respect and dignity.
- Refrain from harassment, discrimination, or abusive behavior.
- Maintain confidentiality regarding other members' shared experiences.
- Not share or distribute community content outside the platform.
- Not use the community for commercial solicitation or spam.
Termination for Misconduct
We reserve the right to terminate your subscription immediately without refund if you violate our community guidelines or engage in behavior that is harmful, threatening, or disruptive to other members or our team.
8. INTELLECTUAL PROPERTY
Our Content
All content provided through The Brotherhood Box, including but not limited to text, graphics, logos, images, coaching materials, and community content, is the property of Kalos Health LLC or its content suppliers and is protected by U.S. and international copyright laws.
Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our services for your personal, non-commercial use only. You may not:
- Reproduce, distribute, or publicly display our content.
- Create derivative works from our materials.
- Use our content for commercial purposes.
- Remove any copyright or proprietary notices.
Trademarks
"The Brotherhood Box" and our logo are trademarks of Kalos Health LLC. You may not use our trademarks without our prior written consent.
9. DISCLAIMER OF WARRANTIES
THE BROTHERHOOD BOX SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- Our services will be uninterrupted, secure, or error-free.
- The results obtained from using our services will be accurate or reliable.
- The quality of any products, services, information, or other material obtained through our services will meet your expectations.
- Any coaching advice or guidance will produce specific results.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALOS DREAMS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, COACHES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Kalos Health LLC, The Brotherhood Box, and our officers, directors, employees, contractors, coaches, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:
- Your violation of these Terms.
- Your use of our services or products.
- Your violation of any third-party rights.
- Any information or content you provide to us.
- Your conduct in connection with our services.
12. DISPUTE RESOLUTION AND ARBITRATION
Informal Resolution
If you have any dispute with us, you agree to first contact us at contact@thebrotherhoodbox.com and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceedings.
Binding Arbitration
If we cannot resolve a dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration Procedures
- The arbitration will be conducted in Los Angeles County, California, or at another mutually agreed location.
- The arbitrator's decision will be binding and final.
- Judgment on the arbitration award may be entered in any court having jurisdiction.
Class Action Waiver
YOU AND WE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in Los Angeles County, California.
14. CHANGES TO TERMS
We reserve the right to modify or update these Terms at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page.
- Notify you via email of any material changes.
- Post the updated Terms on our website.
Your continued use of our services after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must cancel your subscription.
15. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
16. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other legal notices published on our website, constitute the entire agreement between you and Kalos Health LLC regarding your use of The Brotherhood Box services.
